Access Bertie County Court Records

To pull a Bertie County court record, start with the Clerk of Superior Court in Windsor, because that office holds the official file for every case the local courts hear. Public summaries for many matters can be viewed online first, which helps you learn the case number before you contact anyone. Decide early what you actually need. A quick case summary, a filed document, and a clerk-certified copy are three different things, and knowing which one you want saves a step. A Bertie County court records search can point you to the right court and case number, but the official record itself stays with the clerk.

Bertie County Court Records and Clerk

One office holds nearly everything. The Bertie County Clerk of Superior Court at the Bertie courthouse keeps court records for both Superior Court and District Court, from felony and major civil files down to traffic and misdemeanor cases, small claims, estates, special proceedings, judgments, and older paper files. Bertie County has no separate county clerk or municipal-court records office for these matters. The Portal can help you find public case information online. Still, the clerk supplies the official copy. When a file is old, restricted, or simply not online, the clerk's counter is the place to ask.

How to Get Court Records

Know what you are asking for first. A Bertie County record request works best when you can name the case, the court, and the exact item you want. The remote route is the North Carolina eCourts Portal. Its Smart Search can pull up a public Case Summary or Register of Actions for Bertie County cases. Not every item shows on a public screen, though. When it does not, a courthouse terminal or the Bertie Clerk counter are the fallbacks. The clerk's phone line is the practical way to ask about a copy, a certification, or where a file sits. Save mail for after the clerk confirms the request method and how payment is accepted.

  1. Use Smart Search or the case papers to capture the case number, party name, court, and a clear description of the document or entry needed.
  2. Check the public Case Summary and documents available through Portal. The online result may be enough for a public status or event review.
  3. For a paper file, unavailable image, certified copy, or records question, visit the Bertie County Clerk counter or call (252) 794-6800.
  4. Ask the clerk to confirm any copy charge, certification charge, payment method, and whether a mailed request may be sent to PO Box 370.
  5. Use the Judicial Branch administrative request route only when the record is held by that agency, rather than treating it as a substitute for a Bertie case-file request.

One caution about filing systems. File & Serve is the North Carolina eCourts filing system, built for submitting filings, not for searching public records or ordering copies.

Bertie County Portal Court Records

The Portal is free to search and view. Public users get access to eligible Bertie County case information in Enterprise Justice. That is the system also called Tyler Odyssey. Registering an account lets you save cases in My Cases. It grants no extra record authority, however. A public Case Summary can display parties, Case Events, hearings, dispositions, financial information, and eligible documents. Remember that the Portal is not the official Bertie County court record. Certified or complete copies still come from the clerk. The Judicial Branch's official record-obtaining instructions lay out the clerk-office route for inspecting files and getting copies.

That line matters more than it seems. A Portal result from a Bertie County search is fine for finding a case number, but when you need an official document or a certification, the clerk-held file is what counts.

Types of Court Records

A Bertie County court record is more than a case timeline. The full file sits behind it. What the public can reach depends on the case category, the item's status, and whether the file has been converted for online viewing. One office holds it all. The Bertie clerk's custody is unified. So the same Bertie office is generally the right destination for a request, no matter whether a case belongs to Superior Court, District Court, a magistrate matter, or a clerk proceeding.

  • Case Summary or Register of Actions entries and Case Events from an eligible public case.
  • Filed pleadings, notices, motions, orders, and judgments that are public and available.
  • Criminal, traffic, and misdemeanor case files that are maintained through the District Court route.
  • Civil, estate, and nonconfidential special-proceeding files maintained by the Bertie County Clerk.
  • Clerk-certified copies, transcript-of-judgment records, and other clerk services governed by statute.

Bertie County Record Choices

Three record types trip people up in a Bertie County matter. The first is the Portal Case Summary. That is a free public online view of case information and events. The second is a filed document, an item in or alongside the case file, such as an order, judgment, pleading, notice, or eligible audio record. The third is a clerk-certified copy, an official copy the Bertie County Clerk issues. A Portal printout is handy for reading public information on the spot. It cannot substitute for a certified copy when an official court-issued record is required.

What a Court Record Contains

What a record contains varies. It depends on the case and on public-access status. In a Bertie County court record, Portal only displays panels that have information, so a missing section does not mean no event ever occurred. Read dates in context, too. A filing date is not a hearing date, a motion is not an order granting relief, and a charge is not a disposition. The Case Summary and its Case Events help you follow the sequence of a case. The underlying public documents and certified records, though, stay in the clerk's custody.

Case SummaryCase-level information or overview when the public record has it.
Case EventsThe chronological activity list, also called the Register of Actions timeline.
HearingsSetting information when available; confirm a current setting through Search Hearings or the clerk.
DispositionsOutcome information when it is available for the case.
DocumentsPublicly available filings and records, subject to access and redaction rules.
Financial InformationConditional case information that appears only when the system has a relevant panel.

Bertie County Court Records Missing Online

A Bertie County record that is missing online is often not missing at all. The paper file may sit at the Bertie courthouse. The Bertie County Clerk holds it there. Older cases stay off remote display. Restricted matters and files that are simply not public documents stay off as well.

A missing Portal image settles nothing. It does not mean the court docket entry never existed. A self-service terminal in the clerk's office offers another way to inspect a court record in person. A file may be nonpublic or protected. The answer is not a different portal or an old calendar. Ask the Bertie County Clerk about the custody or access rule. Also ask whether a public copy can be provided. The county's Judicial Branch page is the official starting point for local court and calendar routes.

Note: Portal information can appear within minutes after an upload, subject to workload and processing. But that display is not a guarantee that every historic Bertie County item is online.

Certified Copies and Fees

Getting a certified copy in Bertie County starts with the clerk. The clerk turns a Bertie court record into an official copy tied to the identified Bertie case.

There is no separate Bertie price list. North Carolina's clerk-fee statute sets the documented charges for many record services. A plain copy, a certificate under seal, and an exemplification are each their own line item. For a certified docket sheet, check with the clerk before placing the order. Confirm the fee and turnaround time. Also confirm any identification rule. These checks matter most when the item is a particular case document rather than a general record service.

Item under G.S. 7A-308Amount
Certificate under seal$3.00
Exemplification of records$10.00
First page of each document copy$2.00
Each additional copy page or fraction$0.25
Recording, docketing, or indexing first page$6.00
Each additional recording page or fraction$0.25
Transcript of judgment preparation and docketing$10.00
Criminal record search$25.00, subject to statutory exceptions

See the full G.S. 7A-308 fee statute for the statutory text behind these charges.

Bertie County Audio Court Records

Audio requests in Bertie County work best when the case details come first. The Bertie County Clerk needs the case number and hearing information before any proceeding can be located.

Know what you are asking for. A transcript and a docket sheet are different records. A transcript is a written, verbatim record of a proceeding. It may carry independent reporter or transcription costs. Form AOC-G-114 is narrower still. It requests a duplicate of a nonconfidential, electronically recorded District Court hearing. It is not a generic copy-request form. Juvenile and other confidential hearings fall outside the form's stated use. Before sending the form to the Bertie County Clerk, confirm the hearing was eligible. Also check the current submission and payment details.

Proceeding details
Provide the proceeding date, presiding judge, and courtroom where the hearing occurred.
Request certification
Complete the request date, printed requester name, signature, and telephone information.
Payment limitation
The form notes cash, certified check, or money order to the Clerk of Superior Court, with no personal checks.

The AOC-G-114 form also notes that copying, documents, and blank media can carry charges.

Public Access and Sealed Records

Public access to a Bertie County court file starts with the clerk's recordkeeping duty. But access has firm limits.

G.S. 7A-109 requires the clerk to maintain records, files, dockets, and indexes. It generally opens them to public inspection during regular office hours unless another law prohibits it. That is a strong default. It is not a key to everything.

Sealed, expunged, juvenile, and protective-order records stay closed. A public request will not open them. Neither will a Portal account or a courthouse terminal. The clerk can identify the procedural route for a particular file. The clerk cannot give legal advice about an expunction or access eligibility.

Key Rules:

G.S. 7A-109 requires the clerk's court records and supports public inspection subject to legal restrictions.

G.S. 132-6 addresses inspection and copies of public records at reasonable times on payment of lawful fees.

G.S. 132-6.2 does not require a custodian to create or compile a record that does not exist.

Bertie County Case File Requests

Where a request goes matters as much as what it asks for. The state Judicial Branch does have a public-record request route. But that route covers administrative records the agency actually holds. It is not the way. It will not obtain an individual Bertie County court file.

Where do these requests go? A case-specific request, a certification request, or a document question belongs with the Bertie County Clerk. Sending it elsewhere just delays things. It also avoids an unsupported promise that a new compilation will be created.

The Judicial Branch public-record request information explains the administrative route. It also explains its custodian limits.

Use the state route for the agency's own administrative records. For the case file behind a Bertie County court record, the Bertie County Clerk is the direct contact.

Bertie County Paper-Era Court Records

Older Bertie County records take more legwork. A paper-era file may require the Bertie courthouse, the clerk, and the Bertie case number. Nothing can be pulled before that.

Bertie County joined eCourts on April 28, 2025, connecting Portal, Enterprise Justice, and File & Serve. That change did not turn every older paper document into a remotely viewable image. The Portal chronology may lack the underlying record. It may also lack a certification. The answer may still be the Bertie County Clerk, a courthouse terminal, or a copy request.

Note: A paper-era Bertie County file and a certified record can require clerk handling. This holds even when later Case Events are visible through Portal.

Bertie County Federal Court Records

State and federal records live in different systems. State court records stay with the Bertie Clerk and Portal. A Bertie County state case never moves to a federal docket. Its subject matter may seem federal. That alone changes nothing.

Federal civil or criminal matters use the federal court system instead, including the U.S. District Court for the Eastern District of North Carolina and its own clerk procedures. The Eastern District's official court information identifies the separate federal route for records and filings.

The federal route never replaces the Bertie County Clerk for a North Carolina General Court of Justice case. PACER is the federal judiciary's electronic case-record service, with federal registration and fee rules rather than Bertie County record rules.

Use PACER for a federal docket. For a state case record or a clerk-certified copy, return to the Bertie County Clerk or Portal.
